Terms of Service

This is the English version of our Dutch terms. If the two differ, the Dutch version prevails.

These terms cover the Lyvra app, your Lyvra account and the Lyvra+ subscription. The purchase of the Lyvra P1 Dongle is covered by separate terms of sale.

1. Who we are

Where these terms say "Lyvra" or "we", that means 3L Digital, trading as Lyvra Energy.

2. Scope

These terms apply as soon as you create a Lyvra account or use the app. You can read them on this page at any time and download them as a PDF so you can keep them.

If any provision turns out to be void or voidable, the rest stays in force.

3. What Lyvra does, and what it does not

Lyvra is software. It shows what your home uses and generates, converts that into costs, and can run connected devices more cleverly, for example charging your car when electricity is cheap or your solar output is high.

Worth being clear about:

• Lyvra is not an energy supplier. We do not supply electricity or gas, we do not enter into a supply contract with you, and we do not hold a supply licence. Your contract with your energy supplier is entirely separate
• We do not guarantee savings. What you save depends on your tariff, your usage, your devices and the weather. Figures we show are estimates based on your own data, not a promise
• We depend on other people's devices and services. Chargers, inverters, batteries and price feeds are not ours. If one of those parties changes or switches off its integration, a feature may stop working temporarily or permanently
• Price data is indicative. Dynamic tariffs come from external sources. What you actually pay is determined by your energy supplier on your invoice

4. Your account

You must be 16 or older. Keep your details accurate and your credentials private. If you think someone else can access your account, tell us straight away.

You can delete your account at any time, in the app under Settings or at lyvra.energy/en/account/delete. What happens to your data then is set out in our privacy policy.

We may suspend or close an account if someone misuses the service, endangers its security, or seriously breaches these terms. We will tell you and explain why, unless the law prevents us.

5. Free and Lyvra+

The basic version of Lyvra is free. Lyvra+ adds features. What is in each tier is on the pricing page.

Price. Lyvra+ costs €3.99 per month or €34.00 per year, including VAT. All prices shown on the site and in the app are consumer prices including VAT.

How you pay. This depends on where you subscribe:

• In the app (iOS or Android): you buy through the App Store or Google Play. Apple or Google processes the payment and is your counterparty for that transaction
• On our website: you pay through Mollie by iDEAL, card or another offered method

Term and renewal. A monthly subscription runs per month and renews automatically for a further month. An annual subscription runs for a year and renews automatically for a further year. We tell you this here before you subscribe, so renewal is never a surprise.

Cancelling. You can cancel at any time, with a notice period of no more than one month. You cancel the same way you subscribed:

• Subscribed in the app: cancel through your Apple ID or your Google Play account. We cannot do it for you, because the subscription is managed there. The app shows you where to go
• Subscribed on the website: cancel in the app under Settings with a single button, or email hello@lyvra.energy

After cancelling you keep Lyvra+ until the end of the period you paid for, then return to the free version automatically. Your account and your data stay as they are.

Price changes. If we raise the price we tell you by email at least 30 days in advance. If you disagree you can cancel before the new price takes effect. A price rise never applies retroactively.

6. Right of withdrawal for Lyvra+

You have 14 days to withdraw, starting on the day you subscribe.

If you want Lyvra+ active immediately, we ask you to confirm that expressly. If you then withdraw within the 14 days, you pay only pro rata for the days you used it and we refund the rest.

To withdraw, email hello@lyvra.energy or use the model withdrawal form. We confirm receipt and refund within 14 days using your original payment method.

If you bought Lyvra+ in the app, withdrawal and refunds go through Apple or Google. We are happy to point you to the right place.

7. Availability and maintenance

We do our best to keep the service running, but we do not promise uninterrupted availability. For planned maintenance we pick a quiet moment and warn you in advance if it will be noticeable.

Features can change. If we remove a feature you pay for under Lyvra+, we tell you at least 30 days in advance and you can cancel without paying for the remainder of the period.

8. What you can expect from us

The digital content and services we provide will meet what you can reasonably expect under the contract. If something does not work as agreed, tell us at hello@lyvra.energy. We will fix it within a reasonable time and free of charge. If we cannot, you are entitled to an appropriate price reduction or to terminate, as the law provides.

This is your statutory right. Nothing in these terms limits it.

9. What we expect from you

Use Lyvra for your own household, and not to:

• Reverse engineer, copy or systematically scrape the service
• Circumvent security or overload the infrastructure
• Provide false information or use someone else's account

10. Liability

We are liable for damage resulting from an attributable failure on our part, as the law provides.

Beyond that, our liability is limited to the amount you paid us in the twelve months before the damage occurred, with a minimum of €250. We are not liable for indirect damage, lost savings, lost profit or consequential loss.

These limits do not apply in cases of intent or wilful recklessness on our part, damage from death or personal injury, statutory product liability, or where mandatory law provides otherwise.

We are not liable for damage caused by a connected device or third-party service behaving differently than expected, unless that is our fault.

11. Intellectual property

The app, the software, the design and the Lyvra name are ours. You get a personal, non-transferable right to use them for as long as your account exists. The data from your home stays yours, and you can export it in a machine-readable format.

12. Changes to these terms

We may change these terms as the service or the law changes. For a change that disadvantages you we give at least 30 days' notice by email or in the app, and you can cancel free of charge before it takes effect.

13. Complaints and disputes

Complaints go to hello@lyvra.energy. We respond substantively within 14 days, or tell you within that period when you will get an answer.

If we cannot resolve it together, you can use the European ODR platform: ec.europa.eu/consumers/odr.

Dutch law applies. Disputes go to the competent court in the Netherlands. As a consumer, you always keep the right to bring proceedings before the court where you live.
